About The H2B Visa Program


The H-2B Visa allows businesses with one-time, seasonal, peak load or intermittent staffing needs to augment the existing labor force with temporary workers.


The employer's need for recurring temporary workers must generally be 10 months or less during any one year. Companies may bring back the same workers year after year.

To qualify for the H2B program: 

  • The applicant must be a U.S. employer with a job opportunity located within the U.S. to perform temporary or seasonal non-agricultural work
  • The employer's need for the duties to be performed must be justified under either a one-time occurrence, intermittent, seasonal, or peak-load need
  • The employer's need must be a year or less. However, an employer's seasonal or peak load need of longer than 10 months, which is of a recurring nature, must be supported by compelling evidence
  • The Department of Labor regulations require the wages offered to a foreign worker be the prevailing wage rate that is paid to the U.S. workers for the same job



Duration of the Program


The period of the petitioner's temporary need must be a year or less. If there are unforeseen circumstances where the employer's need exceeds 1 year, a new application for temporary labor certification is required for each period beyond 1 year for a maximum of 3 years.


However, an employer's seasonal or peak load need of longer than 10 months, which is of a recurring nature, is generally not accepted.



When to Apply


To allow for the lengthy procedures by the DOL and USCIS, we strongly advise to start the process at least 5 months prior to the arrival date of your workers.



The H-2B Cap


The H-2B Cap refers to annual numerical limitations set by the Congress on the number of workers authorized to be admitted on H-2B visa.

  • The H-2B numerical limit set by Congress per fiscal year is 66,000
  • Foreign workers who are eligible for H-2B status as "returning workers" do not count against the annual numerical cap. Returning workers means workers who were counted against the H-2B annual numerical limit of 66,000 during any one of the three fiscal years prior to the fiscal year of the requested start date
