The H-2B Visa allows businesses with one-time, seasonal, peak load or intermittent staffing needs to augment the existing labor force with temporary workers.
The employer's need for recurring temporary workers must generally be 10 months or less during any one year. Companies may bring back the same workers year after year.

Duration of the Program
The period of the petitioner's temporary need must be a year or less. If there are unforeseen circumstances where the employer's need exceeds 1 year, a new application for temporary labor certification is required for each period beyond 1 year for a maximum of 3 years.
However, an employer's seasonal or peak load need of longer than 10 months, which is of a recurring nature, is generally not accepted.
When to Apply
To allow for the lengthy procedures by the DOL and USCIS, we strongly advise to start the process at least 5 months prior to the arrival date of your workers.
The H-2B Cap
The H-2B Cap refers to annual numerical limitations set by the Congress on the number of workers authorized to be admitted on H-2B visa.
