USCIS Update: H-2B Cap Count

USCIS has reported that the H2B cap for the 1st half of fiscal year 2015 was reached on January 26, 2015.

USCIS has updated the count of H2B visa petitions received and counted towards the H2B cap. As of November 10, 2014, USCIS has approved approximately 10,682 beneficiaries for the 1st half of FY 2015.

 

USCIS Update: H-2B Cap Count for First Half of Fiscal Year 2013

USCIS has updated the count of H2B visa petitions received and counted towards the H2B cap. As of April 19, 2013, USCIS has approved approximately 14,713 beneficiaries for the 2nd half of FY 2013.

 

DOL announcement on new H2B Regulations 2012

DOL has announced that on April 26, 2012, the new H2B Regulations 2012 was preliminarily enjoined by the U.S. District Court for Northern District of Florida, Pensacola Division, and was never implemented. Therefore, for the present time employers should file their H-2B labor certification applications under the previous 2008 regulations.

 

New Countries Eligible to Participate in H-2B Program

The Department of Homeland Security (DHS), in consultation with the Department of State (DOS), has identified 53 countries whose nationals are eligible to participate in the H-2B program for the coming year. Effective Jan. 18, 2011, nationals from the following countries are eligible to participate in the H-2B program: Argentina, Australia, Barbados, Belize, Brazil, Bulgaria, Canada, Chile, Costa Rica, Croatia, Dominican Republic, Ecuador, El Salvador, Estonia, Ethiopia, Fiji, Guatemala, Honduras, Hungary, Ireland, Israel, Jamaica, Japan, Kiribati, Latvia, Lithuania, Macedonia, Mexico, Moldova, Nauru, The Netherlands, Nicaragua, New Zealand, Norway, Papua New Guinea, Peru, Philippines, Poland, Romania, Samoa, Serbia, Slovakia, Slovenia, Solomon Islands, South Africa, South Korea, Tonga, Turkey, Tuvalu, Ukraine, United Kingdom, Uruguay, and Vanuatu. Of these countries, the following were designated for the first time this year: Barbados, Estonia, Fiji, Hungary, Kiribati, Latvia, Macedonia, Nauru, Papua New Guinea, Samoa, Slovenia, Solomon Islands, Tonga, Tuvalu, and Vanuatu.

 

USCIS Update H-2B Cap Count for First Half of Fiscal Year 2011

USCIS has updated the H-2B cap count for the first half of Fiscal Year 2011. As of December 24, 2010, USCIS has approved approximately 28,053 H-2B and 4009 are pending.

 

H-2B Cap Count for the Fiscal Years 2010 and 2011

September 13, 2010

 

USCIS has updated the H-2B cap count for the second half of fiscal year 2010 and first half of the fiscal year 2010. As of April 2, 2010, USCIS has approved approximately 41,108 H-2B petitions for the second half of the fiscal year 2010. And for the first half of the fiscal year 2010, USCIS has received total 6,964 H-2B petitions out of which it has approved 4,835 petitions and 2,129 H-2B petitions are still pending to be approved.

 

H-2B Cap Count for the Second Half of Fiscal Year 2010

USCIS has updated the H-2B cap count for the second half of Fiscal Year 2010. As of April 21, 2010, USCIS has received 24,110 H-2B petitions for the second half of the fiscal year 2010, against the target of 47,000. Of these, USCIS has approved 22,565 beneficiaries and 1,545 are pending.

 

DOL Reopens H-2A Regulations E-Mailbox

The Department of Labor’s Office of Foreign Labor Certification has reopened its H-2A regulations e-mailbox for public inquiries after publication of the H-2A final rule addressing temporary agricultural employment in the U.S.

 

Fiscal Year 2010 H-2B Cap Count

April 5, 2010

 

As of April 5, 2010 USCIS has received approximately 41,108 petitions and out of these USCIS has approved 41,108 H-2B petitions towards the first half of the fiscal year. For the second half of the fiscal year 2010, USCIS has received 22,825 H-2B petitions out of which USCIS has approved 20,533 H-2B petitions and 2,292 are still pending.
